Donald Trump took a serious gut shot in his quest to fend off lawsuits related to his fight against the 2020 election results.
Trump has numerous suits in the works, but this is the first one to get this far in terms of answering the question if Trump has absolute immunity as a sitting president.
Bad news for Trump…
As far as the Clinton-appointed judge is concerned, he does not.
A Firm No!
Judge Emmet Sullivan made his decision based on how this particular issue fell in with Trump’s presidential duties.
According to Sullivan, it was outside that scope, so the immunity he would normally be afforded does not exist.
Sullivan wrote, “If former President Trump disrupted the certification of the electoral vote count, as plaintiffs allege here, such actions would not constitute executive action in defense of the Constitution.
“For these reasons, the court concludes that former President Trump is not immune from monetary damages in this suit.”
He continued, “President Trump continues to spread false claims about the 2022 elections and continues to attempt to pressure officials into nullifying the election results: Plaintiffs extensively allege the efforts of former President Trump and his allies as recently as March 2022 to get state officials to overturn the election results; to endorse and provide financial support to candidates for office who supported his false claims of election fraud; all while fundraising for the 2024 presidential election.
“These allegations are perhaps the opposite of what the Trump Defendants term’ vague suggestions of fear or intimidation.'”
The lawsuit was filed by the NAACP and MWRO for “disenfranchising black voters in Michigan.”
Not to pour gasoline on a fire that is already burning out of control, but my guess is that this is where most of the donations to the Save America PAC are going.
That particular PAC, at one point, had $250 million, and it spent very little on GOP candidates in the 2022 races.
It has, however, spent stacks of cash on Trump’s legal bills.
How much of a difference would that $250 million have made in the last election cycle if the money had gone where donors actually thought it was going?
