Trump Attorneys File Amicus Brief

President-elect Donald Trump’s team has filed an amicus brief to support Texas in their efforts to sue the Biden administration for selling off border wall materials to sabotage the incoming Trump administration’s efforts to quickly secure the border.

Earlier this month, it was revealed that President Joe Biden’s administration had begun selling border wall materials that had been sitting along the border since Trump left office. Rather than use those materials to keep Americans safe from illegal immigration or at the very least leaving them there for the Trump administration to use, Biden started selling them in a government auction for pennies on the dollar just before Trump will take office. As Trump’s campaign was largely focused on border security and illegal alien crimes, it is clear that the Biden administration’s decision to sell off border wall materials in the remaining weeks before Trump takes office is part of an effort to sabotage Trump.

The Daily Wire has obtained the amicus brief filed by Trump’s team in support of legal action taken by Texas and Missouri against the sale of these materials.

“The outgoing Biden Administration’s reported ‘fire sales’ of border-wall materials to private parties raise grave concerns about the legality of Defendants’ conduct and their compliance with this Court’s permanent injunction in this case,” the amicus brief states. “The Court should order an immediate stop of all such sales and perform a searching examination of the Government’s conduct—by ordering formal discovery if necessary—to ensure compliance with the Constitution, the law, and the Court’s orders.”

“The Court should issue an order directing the Defendants to immediately stop any ongoing sale of border-barrier materials to private parties pending the Court’s review of Defendant’s conduct, and the Court should swiftly conduct a searching examination of the Government’s conduct, by formal discovery if necessary, to examine the Government’s compliance with the law, the Constitution, and the Court’s injunction,” the brief concludes.

Meanwhile, the Biden administration is desperately trying to defend their actions following the backlash over the auctioning of border wall materials — with one official claiming that their actions were in line with the 2024 National Defense Authorization Act (NDAA), according to Fox News. However, Trump’s team pointed out in the amicus brief that the language of the NDAA “does not mandate or authorize DoD to sell the excess border wall material at a steep discount to private parties.”
