In a stunning development this week, plaintiffs in a civil lawsuit filed against Kyle Rittenhouse, Facebook and the Kenosha Guard militia group have dropped their suit. The suit alleged that Facebook was negligent because they allowed Kenosha Guard leader Kevin Mathewson to post a call for militia members to come to Kenosha. The suit further claims that the defendants, according to Kenosha News, “had conspired to violate their civil rights”.
Filed For Dismissal “With Prejudice”
The plaintiffs are reportedly, Hannah Gittings, girlfriend of Anthony Huber, one of the men shot by Rittenhouse and three other rioters who claim they were “harassed” by the militia group. Attorney for the plaintiffs Jason Flores-Williams, filed the dismissal with prejudice, meaning the suit is dismissed permanently and cannot be refiled without explanation. Typically a dismissal with prejudice indicates a case lacks merit or evidence.
According to Cornell Law,
“When a lawsuit is dismissed with prejudice, the court is saying that it has made a final determination on the merits of the case, and that the plaintiff is therefore forbidden from filing another lawsuit based on the same grounds.”
“In concluding the case we have agreed to no comment,” Flores-Williams said in an email.
Kenosha News reports that other suits are still pending they wrote, “Huber’s family and Gaige Grosskreutz, 26, who was seriously injured in the shootings, filed notices of claim indicating they will sue the City of Kenosha and Kenosha County, alleging that law enforcement negligence contributed to the shootings.”
Update on The Rittenhouse Self-Defense Trial
In Kyle Rittenhouse’s self-defense case for the shootings in August Judge Schroeder handed the defense a huge win and rebuked the District Attorney’s transparent attempts to increase his bond by $200k and re-arrest Rittenhouse due to his relocation to a safehouse in response to threats on his life without notifying the DA’s office. Even knowing of the threat, the DA pushed to publicize Rittenhouse’s new address, which the Judge vehemently denied.
Epoch Times reported,
“Schroeder did require Rittenhouse to register his current address with the court, but it will be kept under seal and only he and the Kenosha County Sheriff’s Department would have access to it.”
