Manhattan’s uber-progressive DA has finally gotten some common sense.
After significant pressure, he has decided to drop the charges against the bodega worker that killed his attacker.
Jose Alba is now free and clear of the second-degree murder charges he was facing.
Just Common Sense
If you recall the case, Alba was working at a local bodega when the boyfriend of a customer came back to the store and went after him.
Alba, who was physically overmatched, grabbed a knife and started to stab his attacker.
The assailant’s girlfriend ended up pulling her knife and stabbing Alba, but she was not even arrested.
There was national outrage when Alba was initially charged, but the DA must have felt the pressure because Jennifer Sigall, assistant district attorney under Manhattan District Attorney Alvin Bragg, filed a motion to dismiss the charges.
Bragg’s office stated, “Following an investigation, the People have determined that we cannot prove beyond a reasonable doubt that the defendant was not justified in his use of deadly physical force.
“As such, the People will not be presenting the case to a Grand Jury and for the reasons provided in the attached memorandum, hereby move to dismiss the complaint.”
Later that same day, the filing had come across the desk of a judge, who granted the dismissal.
