As the 2024 Presidential Election continues to draw ever closer, there are some who are beginning to wonder whether or not former President Donald Trump will be appearing on the ballot.
Arizona Secretary of State Adrian Fontes, a Democrat elected to his position in 2022 and former Maricopa County Recorder from 2017-2021, is taking this issue “very seriously” as he investigates how to handle any complaints that may arise around Trump’s presence on the ballot.
He predicts that the matter will ultimately end up in court.
Section 3 of the 14th Amendment states that anyone who has engaged in insurrection or rebellion against the Constitution is barred from holding federal office again.
This amendment was ratified back in 1868 with its original intent being to keep former Confederate officials out of government after The Civil War.
Conservative legal scholars William Baude and Michael Stokes Paulsen have argued that this should disqualify Trump from running for president again.
The Attorney General’s Office of New Hampshire is currently reviewing whether or not Section 3 could prohibit Trump from appearing on their state’s ballots next year.
However, they have made it clear that neither office has decided yet if his actions should prevent him from being reelected president either way.
New Hampshire GOP Chairman Chris Ager spoke publicly about this issue recently, assuring listeners that all 14 current candidates will indeed be included on their primary ballot come time for decision making.
