Donald Trump and his attorneys are not going to be happy.
In the January 6 case, Judge Chutkan allowed Special Counsel Jack Smith to file a monstrous filing outlining the evidence against Donald Trump in the case.
Now, if she chooses, Judge Chutkan can release the information to the public.
The October Surprise
This is arguably one of the cases that can do Trump the most damage.
Trump and his attorneys continue to argue that Trump should be immune from charges, but most legal experts do not see it that way.
It will be very hard for Trump to make the case the Stop the Steal rally was the act of a present over that of a candidate or private citizen.
And remember, Chutkan has already stated the election will not come into play in any decisions she makes in this case.
She confirmed that again during one of the more recent hearings, stating, “Defendant’s concern with the political consequences of these proceedings does not bear on the pretrial schedule.”
Even though this case has no shot of going into the courtroom before the election, Trump will still have to deal with the court of public opinion.
I fully expect Chutkan to release this information, so the question now is how much and how soon.
There will clearly be some redactions to protect witnesses, but I suspect that Chutkan will do everything she can to release as much information as possible.
I also see her releasing this information about two weeks outside of the election where it will do the most damage to Trump.
At that point, absentee ballots will have been mailed, early voting will be starting, and it would also impact people voting on election day.
This would also give Harris and her campaign plenty of time to use the information against Trump, and rest assured, Chutkan does not want to see Trump in the White House again.
While she has never used his name in her rants from the bench, it seems pretty clear to me she believes Trump should be behind bars, not in the Oval Office.
I honestly don’t think she even cares if she is setting up Trump for a successful appeal as long as she can stop him from winning this election.
