John Lauro, former attorney for President Donald Trump, has seen a silver lining in the Department of Justice’s (DOJ) latest indictment against his client.
According to Lauro, this gives Trump an opportunity he never had before: subpoena power over the 2020 presidential election case.
Lauro made these comments during an interview with Fox News host Bret Baier on Tuesday night after special counsel Jack Smith announced that Trump was being indicted.
The charges included conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding and conspiracy against rights.
These were in response to Trump’s questioning of the integrity of the 2020 election results.
In spite of these allegations from Smith that Trump knowingly made false statements about the election, Lauro maintained that it is still protected under free speech due to First Amendment rights.
He argued that what Trump did on January 6th was “exactly constitutionally precise and in order” as noted by Article II Section 1 Clause 2 which states that each state can appoint electors in whatever manner their legislature directs them too.
Thus according to Lauro what Trump did was not illegal but instead was done out of his responsibility as president to ensure a valid election process took place.
This case will allow trump and Republicans litigate why they believe the 2020 Presidential Elections were fraudulent so evidence can be presented correctly this time around without having limited resources like what happened previously when filing lawsuits at various courts throughout America.
