The Supreme Court issued a decision that Joe Biden did not want to see.
Ironically, that decision is ultimately going to save Joe Biden.
Supreme Court Justice Roberts has halted the removal of Title 42, at least for the time being.
Sooner or Later…
The argument being given by the administration to end Title 42 is that it is not needed any longer.
Because the rule was put in place as a health rule, it will eventually be ended.
The lawsuit fighting the removal of the rule was brought about by the attorneys general from Texas and Missouri.
There are members of Congress on both sides that would like to see this rule codified, but that is unlikely until the GOP takes the House.
Then the question becomes if we have enough Democrats in border states that would agree to vote this rule into law.
Even then, it would have to be signed by Biden, which is not going to happen.
Regardless, the rule is still in effect for now, with the DHS responding, “While this stage of the litigation proceeds, we will continue our preparations to manage the border in a safe, orderly, and humane way when the Title 42 public health order lifts.
“We urge Congress to use this time to provide the funds we have requested for border security and management and advance the comprehensive immigration measures President Biden proposed on his first day in office.”
If the rule is lifted, El Paso, TX, which currently sees about 1,500 illegal immigrants per day, is expecting an immediate surge of as many as 5,000 per day.
