Report: Bombshell Backdoor Deal Allows For Legal Loophole

Migrants learned a legal loophole to exploit and they’re lining up at the gates. The flow suddenly dropped along with the end of Title 42. That was exactly the opposite of what was expected and the reason is because a federal judge in Florida told them they have to hold everyone in custody. Parole is illegal so they must cage every asylee until they get a court date or get deported, whichever comes first. Even though he hates to have to do it, Alejandro Mayorkas has been deporting them in droves.

Migrants slip through legal hole

Things in Tijuana are pretty interesting, right now. Title 42 ended on May 11 and since then, “migrants have been told the only way to get into the U.S. for an asylum interview is to secure an appointment via the CBP One app.” Yeah right, the unwashed masses protest. That piece of crap doesn’t work.

It appears, Border Report writes, some invaders “have found a loophole in the requirement and have begun camping out at the San Ysidro Port of Entry waiting for access to the U.S.

Cesar Segura is one of the migrants “claiming the technology used by the CBP One online system for appointments is faulty, thus giving him and others a reason to ask for an appointment in person at ports of entry such as San Ysidro.

The loophole works better than the app. The problem is that word leaked out and everyone is trying that approach.

The way Mr. Segura explains it, the “application, as is, it’s just not working, we thought it would be better, but if anything it’s gotten slower. One is able to come to a port of entry without an appointment for processing.

DHS doesn’t want to encourage migrants to expect the hack to work every time but “technically, according to a DHS provision, Segura is right.

Camping at the border

Officials are going to have a hard time explaining to the thousands of migrants suddenly “camping out at the San Ysidro Port of Entry hoping Customs and Border Protection officers will grant them access into the U.S. for asylum appointment.

Under the rules, asylees “are allowed to seek entry into the U.S. at a port of entry if they can’t use the CBP One app due to language barriers, illiteracy or technical issues.” Each and every one can claim language barriers and illiteracy even if the system weren’t riddled with technical glitches.

Segura decided that camping at the border was a more promising way to gain entry to the land of milk and honey “after repeated failed attempts to get an appointment via the app.” He’s not alone.

Judging by the long line, many migrants are becoming aware of this loophole and are camping out along the pedestrian lanes leading into the border crossing from Tijuana.” Once the word spreads, the herd migrates following the smell of the rumors. “Many can be seen walking up to CBP officers who take down names and nationalities.

The migrants are more encouraged every time the border guards open the gate and let some more in. “I’ve seen some families going in already without appointments,” declares Segura. “I’m going to stay here as long as it takes to be seen by U.S. personnel.

Nobody had the heart to explain to him under the current situation there’s about a 90 percent chance he’ll be deported back to where he came from. Mayorkas is working on that but since there hasn’t been any word of how his appeal is going, that suggests it’s not going well.
