The Biden administration just purposely blew off a deadline in a significant case for transgender rights.
Since the deadline was missed, the ruling in the lower court will hold.
While religious groups celebrated the win, we are not entirely out of the woods just yet.
One More to Go
The case centered around an Obama-era order that forbid doctors and hospitals from turning away someone for transgender reassignment surgery, including children.
The case fell to the 5th Circuit, with an appeal deadline of November 22.
The ruling was a successful step in the fight to protect doctors’ conscience rights. The fight continues in the Eighth Circuit, where we expect a ruling soon.

Goodrich added, “The final demise of this unconscionable mandate is a major victory for conscience rights and compassionate medical care in America.
“Thousands of doctors will be able to do their jobs without the government requiring them to perform harmful, irreversible procedures against their conscience and medical expertise.”
In that tweet, he referred to the second case, so I am thinking the administration thought they had a better chance on the 8th Circuit, so that is where they chose to do battle.
I would imagine regardless of the outcome of that case, this one is headed to the Supreme Court.
