Judge Tosses Charge in Rittenhouse Case, Prosecution Falls Short

Judge Bruce Schroeder, who is overseeing the trial of Kyle Rittenhouse, has dismissed one of the charges against the teen after the prosecution failed to prove it.

Kyle Rittenhouse, who killed two men and wounded another in self-defense during the 2020 BLM riots in Kenosha, Wisconsin, is currently facing six charges: five felonies and one misdemeanor. The felony charges include intentional homicide, reckless homicide, attempted intentional homicide, and two charges of reckless endangerment. The misdemeanor charge is possession of a deadly weapon by a minor.

On November 9th, Judge Schroeder threw out a charge of breaking curfew in the trial, ruling that the prosecutors had failed to produce any evidence that a curfew had been in place that night in Kenosha.

This is just the latest blow to Assistant District Attorney Thomas Binger and James Kraus’ case against Rittenhouse, as the two have been suffering significant setbacks nearly every step of the way in their attempts to imprison the teenager for saving himself from attacks by violent rioters that were allowed to destroy Kenosha.

The biggest setback in the case happened on November 8th, where yet another one of the state’s witnesses ended up hurting the state’s case. Gaige Grosskreutz, who was the third person shot by Rittenhouse that night, and the only one to survive the ordeal, admitted to the defense lawyer that he had only been shot by Kyle after he had “advanced” on him while pointing a pistol at the teen.

Prior to that admission, the state, the media, and Grosskreutz himself had been claiming that he was shot while “surrendering” to Kyle with his hands up. The defense was able to disprove this through cross-examination of Grosskreutz.

According to reporting from The Daily Wire, the cross-examination went as follows:

Corey Chirafisi: Now, you’d agree your firearm is pointed at Mr. Rittenhouse. Correct?

Gaige Grosskreutz: Yes.

CC: Okay. And once your firearm is pointed at Mr. Rittenhouse, that’s when he fires his gun. Yes?

GG: No.

CC: Sir, look, I don’t want to – does this look like right now your arm is being shot?

GG: That looks like my bicep being vaporized, yes.

CC: Okay. And it’s being vaporized as you’re pointing your gun directly at him. Yes?

GG: Yes.

CC: Okay. So when you were standing 3-5 feet from him with your arms up in the air, he never fired. Right?

GG: Correct.

CC: It wasn’t until you pointed your gun at him, advanced on him with your gun — now your hands down — pointed at him that he fired. Right?

GG: Correct.

Of course, the media is still avoiding reporting on the defense catching Grosskreutz in a lie, choosing to continue to push the narrative that he was shot while his hands were up. Many conservatives are speculating that the media is trying to provoke more riots, hoping that enough radical leftists are convinced that Rittenhouse is an evil murderer so that when he is acquitted, they believe it was an unjust ruling and begin rioting across the country.
