Frank Garrison stunned the White House with a lawsuit this week.
I doubt the suit will hold up, but it is more than likely the first of many challenges for this administration on the student loan forgiveness order signed by Biden.
This suit, however, is odd in that it is someone eligible for forgiveness that is blocking Biden.
Don’t Want It
Garrison lives in Indiana.
This is a state that plans on taxing the giveaway as income.
Garrison has run the numbers and he believes he is better off financially paying the loan than taking the credit.
Caleb Kruckenberg, an attorney at Pacific Legal Foundation, stated, “Congress did not authorize the executive branch to unilaterally cancel student debt.
“It’s flagrantly illegal for the executive branch to create a $500 billion program by press release, and without statutory authority or even the basic notice and comment procedure for new regulations.”
The White House was stunned by the lawsuit, claiming the complete opposite of Garrison.
Karine Jean-Pierre stated, “The bottom line is this: no one who does not want debt relief will have to get that debt relief, so folks have an option to opt-out.
“But again, this is going to help tens of millions of Americans–Americans who are now going to be able to put money down to maybe buy a house or start a family, and that matters.”
White House spokesman Abdullah Hasan added, “No one will be forced to get debt relief.
“Anyone who does not want debt relief can choose to opt out.”
“Why would this group bring this baseless claim?
“Because opponents of the debt relief plan are trying anything they can to stop this program that will provide needed relief to working families.”
I doubt this suit will stick, but I expect the GOP to start coming after Biden very soon with everything it has.
More than a few constitutional experts have stated that Biden has overstepped his authority here, so this is far from over.
