The Republican Party was dealt a loss by the Supreme Court that it clearly never expected.
The case centered around the so-called “independent state legislature” theory.
The decision came down 6-3 against the GOP, but even the dissenting opinions did not bode well for Republicans.
Strike It Down
On Tuesday, the 6-3 decision was handed down with Chief Justice John Roberts, Justice Kavanaugh, and Justice Coney Barrett siding with the liberal side of the bench.
This means the decision that has been previously handed down by the North Carolina Supreme Court will stand.
That decision had concluded that the district map constituted a partisan gerrymander.
The Supreme Court, in its ruling, did not embrace the “independent state legislature” theory.
Republicans have claimed this limits state courts from being able to strike down some election laws.
The North Carolina Republican Party Chairman stated, “At the end of the day, the U.S. Supreme Court said that the North Carolina courts could review our congressional maps.
“Our North Carolina Supreme Court has reviewed our congressional maps.
“They have said that the courts cannot draw the maps themselves.
“We’re actually in a really good place in North Carolina because last election cycle, we won the Supreme Court, and our court has reviewed the maps and said that we need to get new ones.”
That is what they call making lemonade out of lemons.
Liberal outlets were celebrating this as the “shock” defense of our democracy by the Supreme Court.
