Get ready for the cries that Senator Ted Cruz (R-TX) is a homophobe.
Cruz stirred the pot this week on same-sex marriage.
He reiterated a point made by Justice Thomas after Roe v. Wade was overturned, igniting a firestorm on the left.
Bad Precedent
If it was a faulty ruling, there is nothing wrong with overturning a precedent.
That was the case for Roe v. Wade in terms of abortion rights.
This sent the matter back to the states.
Cruz believes the decision in Obergefell v. Hodges also falls into that category.
If that decision is overturned, it would turn same-sex marriages back to the states.
Cruz stated that “some states were moving to allow gay marriage, other states were moving to allow civil partnerships.
“They were different standards that the states were adopting.”
He also pointed to the chaos that would happen, stating, “You’ve got a ton of people who have entered into gay marriages and it would be more than a little chaotic for the court to do something that somehow disrupted those marriages.”
Justice Thomas has been criticized, even by his fellow conservative justices, for suggesting the court look at numerous precedents and overturn them, including access to birth control, which is just utterly ridiculous.
Justices Kavanaugh and Alito addressed that specific issue in the recent decision.
Justice Kavanaugh stated, “Nothing in this opinion should be understood to cast doubt on precedents that do not concern abortion.”
Justice Alito added, “We emphasize that our decision concerns the constitutional right to abortion and no other right.”
While Cruz seems ready to fall in line with Thomas, he does not believe the majority of the court would follow suit, stating that the court members do not have “any appetite” for overturning the cases that Justice Thomas mentioned after Roe v. Wade.
