Biden has one swing left and it will be with the Supreme Court.
The 5th Circuit Court of Appeals has upheld the stay on Biden’s student loan forgiveness order.
Now the administration is making an appeal to the Supreme Court.
It’s Illegal
In the first round, it was a Trump judge that shot the order down, so Dems were complaining about a biased judge.
In the second round, it was a unanimous decision with judges appointed by Bush, Obama, and Trump.
That is a pretty big deal.
I do not see any way that five justices can see this order as constitutional.
We are talking about hundreds of billions of dollars that Biden thinks he can spend with a swipe of his pen rather than going through Congress.
This order was unconstitutional from the outset, and Biden knew it.
He did it for votes, so now it is all freewheeling.
