In fear of a possible unanimous overturning of a longtime precedent, the Biden administration has reached out to the Supreme Court.

The case involves citizenship rights for American Samoans.
This issue is a hot issue for both Justices Nel Gorsuch and Sonia Sotomayor.
Considering the bipartisan support and passion for the cause, the decades-old precedent would be reversed.
So, the Justice Department’s Solicitor General Elizabeth Prelogar petitioned the court to stay out of the way of the case.
Prelogar wants the decision to remain with Congress, not return to the Supreme Court.
She wrote, “The government in no way relies on the indefensible and discredited aspects of the Insular Cases’ reasoning and rhetoric.
“This case would be an unsuitable vehicle for reexamining those cases.”
Neil Weare, president and founder of Equally American, a group that supports equal rights in U.S. territories, was livid by the filing.
He wrote, “It is shocking that the Biden-Harris Administration and the Solicitor General continue to breathe life into the Insular Cases, which were grounded in a vision of white supremacy that has no place in our society, much less briefs filed by the U.S. Justice Department.”
In all likelihood, the Supreme Court will announce later this year if it will take the case or not.
