The exhaustively slow movement in our nation’s legal process has come to a head as to the issue of whether or not the Maricopa County Republican Committee was operating within the scope of its legal rights in calling for a new election.
At the focal point of all this controversy was an election to appoint new officers in Legistlative District 3.
During the day long bench trial, the lawyers representing the ousted LD3 chair have made claims that the county party overstepped its bounds of authority when it came to electing officers outside of the normally prescribed timeframe.
The Maricopa County judge in charge of overseeing the case made a point to note that neither the bylaws or the statute itself gave the county any manner of authority to hold a new election.
Maricopa County Superior Court Judge Frank Moskowitz explained further that his analysis stood on the notion of whether the statute should be interptreted to bar any future elections in any context, pointing out the the court’s inability to engage with the political party in question.
He went onto explain further that he has to figure out exactly how far reaching the statue was in practice. The judge also pointed out that there are several potential mitigating factors that the statute does not address.

Candace Czarny, LD3 chair, had been elected in December but later saw her booted out of her position after the party organized a new election. Czarny then filed a lawsuit alleging that county chair Craig Berland went beyond the scope of his authority organizing the electing of new officers.
Bryan Blehm, attorney for MCRC, went on to argue that Berland and the county had no choice but to schedule new elections in order to satisfy a timely election challenge.
Czarny’s attorney later questioned a former LD3 chair if he had seen any instances of someone submitting a ballot that was not their own.
The former chair then went on to testify that people were only allowed to submit ballots through another person in instances of medial emergency. Former chair Rutkowskit then went onto state that doing so was well within state law.
